Terms of Use

1. Introduction and Electronic Record
This document is an electronic record in terms of the Information Technology Act, 2000 and the rules thereunder as applicable. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Welcome to the XplorEast mobile application (the “App”). This App is operated by XplorEast, a company incorporated under the Companies Act, 2026 and having its registered office at D-60, 3rd Floor, Amar Colony, Lajpat Nagar 4, New Delhi – 110024 (“we,” “us,” or “our”). These Terms of Use (“Terms”) constitute a legally binding agreement between you (“you” or “your”) and XplorEast governing your use of the App and the purchase of goods or services from us.

2. Agreement to Terms
By downloading, accessing, or using the App, or by clicking “I agree” or checking any similar option presented to you, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy https://xploreast.in/privacy-policy. If you do not agree to these Terms, you must not download or use the App.

3. Eligibility and Contractual Capacity
By agreeing to these Terms, you represent and warrant that:

  • You are an individual, at least 18 years of age;
  • You are of sound mind, solvent, and competent to contract as per the Indian Contract Act, 1872;
  • If you are under 18, you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. We do not knowingly collect personal data from children without appropriate consent.

4. User Accounts and Registration
To access certain features of the App, such as making a purchase, you may be required to create an account.

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate, current, and complete information during registration.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately at info@xploreast.in of any unauthorized use of your account.
  • We may require or enable multi-factor authentication to enhance security, and you agree to follow any such procedures we implement.

5. Orders and Purchases

  • Product Information: We make every effort to display the products and colors that appear in the App as accurately as possible. However, we cannot guarantee that your device’s display will accurately reflect the product.
  • Pricing: All prices are displayed in Indian Rupees (INR) and are inclusive of all applicable taxes unless otherwise specified. We reserve the right to correct any pricing errors.
  • Order Acceptance: Your submission of an order constitutes an offer to purchase goods from us. A binding contract of sale is formed only when you receive an order confirmation from us. We reserve the right to refuse or cancel any order for any reason at any time.
  • Payment: All payments are processed securely through our payment partners. By providing payment information, you represent that you are authorized to use the payment method. Your use of UPI, cards, or other payment methods is subject to the applicable guidelines of the National Payments Corporation of India (NPCI) and our payment partners.
  • Consent for Purchase: We will only record your consent for the purchase of any good or service where such consent is expressed through an explicit and affirmative action (such as clicking a confirmation button). We do not record consent automatically, including through pre-ticked checkboxes.

6. Shipping, Delivery, and Returns

  • Shipping: We will ship goods to the address you provide during checkout. Shipping costs and estimated delivery times will be provided before you complete your purchase. Risk of loss and title for items purchased from us pass to you upon delivery of the items to the carrier.
  • Returns and Refunds: Please review our separate Return and Refund Policy [link to your Return Policy], which is incorporated into these Terms. That policy explains how to return products you have purchased from us. In accordance with Indian consumer protection laws, we will not unreasonably refuse refunds or returns if goods are found to be defective, deficient, spurious, or do not match the description in the advertisement. We also do not impose cancellation charges on consumers cancelling after confirming purchase unless similar charges are also borne by us if we cancel the order unilaterally.

7. Right of Withdrawal (Cancellation)
As a consumer, you have the right to cancel your order prior to shipment. Once the product is shipped, you may return it in accordance with our Return and Refund Policy. To exercise your cancellation right, you must inform us of your decision by a clear statement (e.g., an email to info@xploreast.in). We will process all refunds in accordance with applicable law.

8. Intellectual Property Rights
All content included in the App, such as text, graphics, logos, icons, images, and software, is the property of XplorEast or its licensors and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

9. App License and Restrictions
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices that you own or control. You agree not to:

  • Copy, modify, or reverse engineer the App.
  • Remove any copyright or proprietary notices from the App.
  • Use the App for any illegal purpose or to transmit malware or harmful code.
  • Attempt to gain unauthorized access to our systems.

10. Prohibited Activities and User Obligations
You may not use the App to upload, share, or transmit any information that:

  • Is patently false or misleading;
  • Promotes enmity between different groups on the grounds of religion or caste with the intent to incite violence;
  • Threatens public order;
  • Violates any applicable laws or regulations;
  • Infringes upon our intellectual property rights;
  • Harasses, abuses, or harms others;
  • Interferes with the security or functionality of the App.

We shall make reasonable efforts to ensure that users do not publish such prohibited content on our platform.

11. Grievance Redressal Mechanism
In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020, we have appointed a Grievance Officer.

  • Response Time: All complaints shall be acknowledged within 48 hours and redressed within one month (30 days) from the date of receipt. Requests for removal of unlawful content shall be addressed expeditiously, within 72 hours.

12. Limitation of Liability
To the fullest extent permitted by Indian law, XplorEast shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the App or any goods purchased through the App. Notwithstanding the foregoing, our total liability to you shall not exceed the amount paid by you for the specific product or service giving rise to the claim.

13. Disclaimer of Warranties
Your use of the App is at your sole risk. The App and all products and services delivered to you through the App are (except as expressly stated by us) provided “as is” and “as available” for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Indemnification
You agree to indemnify, defend, and hold harmless XplorEast and our officers, directors, employees, and agents from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third-party.

15. Termination
We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, a breach of these Terms. Upon termination, your right to use the App will cease immediately.

16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms or the App shall be subject to the exclusive jurisdiction of the courts in Delhi. Any attempt by parties to otherwise modify the jurisdiction shall be null and void.

17. Changes to Terms
We may revise these Terms at any time. Any modifications will become effective upon posting to the App, unless otherwise stated. We will provide notice of material changes via in-app notification or email, and your continued use of the App after such changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must immediately stop using the App.
